Road Running Rentals

These Terms & Conditions (“Terms”) govern the rental and use of vehicles provided by Road Running Rentals (“Company,” “we,” “us,” or “our”). By making a reservation, signing a rental agreement, accepting a vehicle, or using one of our vehicles, you (“Renter,” “you,” or “your”) agree to comply with these Terms and any additional terms contained in your rental agreement.

1. Eligibility to Rent

To rent a vehicle from us, you must:

  • Meet the minimum age requirement applicable to the vehicle and rental location.
  • Possess a valid driver’s license that is legally recognized for driving in the applicable jurisdiction.
  • Provide accurate and complete personal information and documentation.
  • Provide valid identification and any additional documents reasonably requested by the Company.
  • Meet our applicable insurance and eligibility requirements.
  • Have a valid payment method accepted by the Company.
  • Satisfy any driver-screening or verification requirements.

Additional drivers may only operate the vehicle if they have been properly authorized and approved by the Company.

2. Driver’s License and Identity Verification

The Renter must provide a valid driver’s license and identification when required.

We may verify the validity of your driver’s license, identity, driving eligibility, and other information before or during the rental period.

Providing false, misleading, expired, fraudulent, or altered documents may result in cancellation of the reservation or termination of the rental agreement.

The Renter is responsible for ensuring that all information provided to us remains accurate.

3. Reservations

Reservations are subject to vehicle availability and confirmation by the Company.

A reservation does not necessarily guarantee a specific vehicle make, model, color, or trim level unless expressly confirmed in writing.

The Company reserves the right to refuse or cancel a reservation when the Renter does not satisfy applicable rental requirements.

Pickup and return times must be observed. Additional charges may apply when a vehicle is returned late.

4. Rental Period

The rental period begins when the vehicle is released to the Renter and ends when the vehicle has been returned to the agreed location, keys have been returned, and the Company has accepted possession of the vehicle.

The Renter may not extend the rental period without prior authorization.

Failure to return the vehicle on time may result in additional rental charges, late fees, recovery expenses, or other applicable charges.

5. Payment and Security Deposit

The Renter agrees to pay all rental charges and other amounts due under the applicable rental agreement.

Depending on the rental, charges may include:

  • Base rental charges
  • Taxes and applicable government fees
  • Security deposits
  • Additional mileage charges
  • Late-return charges
  • Cleaning charges
  • Fuel or charging charges
  • Tolls and toll administration fees
  • Parking fees
  • Traffic tickets and violations
  • Damage charges
  • Loss-of-use charges where applicable
  • Vehicle recovery or towing charges
  • Administrative fees
  • Other charges expressly disclosed in the rental agreement

A security deposit or authorization may be required before the vehicle is released.

6. Payment Authorization

By providing a payment method, the Renter authorizes the Company to process authorized rental charges and other amounts properly due under the rental agreement.

Where permitted by law and applicable to the rental agreement, the Company may charge the payment method for unpaid rental charges, tolls, tickets, damage, cleaning, fuel, late returns, or other authorized expenses.

7. Insurance Requirements

The Renter is responsible for maintaining any insurance coverage required by law and by the rental agreement.

Unless expressly stated otherwise in writing, insurance is not included in the rental price.

The Renter must provide proof of valid insurance when requested.

The Renter is responsible for ensuring that their insurance policy permits the use of the rented vehicle and provides any coverage required for the rental.

Failure to maintain required insurance may result in termination of the rental agreement and additional liability for the Renter.

8. Tolls, Tickets, Fines, and Violations

The Renter is responsible for all tolls, parking charges, traffic tickets, citations, fines, penalties, and other charges incurred during the rental period.

This includes, where applicable:

  • Electronic toll charges
  • Parking violations
  • Speeding tickets
  • Red-light violations
  • Camera-based violations
  • Traffic citations
  • Registration-related violations
  • Other governmental penalties associated with the vehicle during the rental period

The Company may provide renter information to the applicable governmental authority or toll agency when legally required or permitted.

Administrative fees may apply where permitted by law.

9. Vehicle Use

The vehicle must be operated responsibly and in accordance with applicable federal, state, and local laws.

The Renter agrees not to:

  • Use the vehicle for any illegal purpose.
  • Operate the vehicle while under the influence of alcohol, drugs, or any substance that impairs driving ability.
  • Use the vehicle for racing, speed testing, or other competitive driving.
  • Use the vehicle for towing or pushing another vehicle unless expressly authorized.
  • Transport hazardous or prohibited materials.
  • Use the vehicle in a manner that could reasonably cause excessive damage or wear.
  • Tamper with or disable GPS, telematics, safety, or security equipment.
  • Allow an unauthorized person to drive the vehicle.
  • Use the vehicle outside an authorized geographic area when such restrictions apply.
  • Sublease, rent, lend, or otherwise transfer possession of the vehicle to another person.

10. Gig-Platform and Commercial Use

If the vehicle is rented for use with a rideshare, delivery, or other gig-economy platform, the Renter is responsible for complying with all applicable platform requirements and laws.

The Renter must maintain any insurance, permits, licenses, registrations, and other requirements applicable to such use.

Use of the vehicle for commercial, rideshare, delivery, or gig-platform purposes is permitted only when expressly authorized by the Company and the rental agreement.

The Renter remains responsible for any claims, penalties, violations, or losses arising from unauthorized or unlawful commercial use.

11. Mileage Restrictions

Mileage limitations, if applicable, will be disclosed in the rental agreement or reservation terms.

The Renter is responsible for additional mileage charges when the permitted mileage is exceeded.

Mileage must not be manipulated, disconnected, altered, or otherwise interfered with.

Tampering with an odometer or vehicle mileage-recording system is strictly prohibited.

12. Vehicle Condition

The Renter agrees to inspect the vehicle before accepting it and to report any existing damage or condition concerns to the Company as soon as reasonably possible.

By accepting the vehicle, the Renter acknowledges the vehicle’s condition as documented by the Company, subject to any previously reported damage.

The Renter must return the vehicle in substantially the same condition in which it was provided, excluding ordinary wear and tear.

13. Damage to the Vehicle

The Renter may be responsible for damage occurring during the rental period, subject to applicable law and the terms of the rental agreement.

This may include damage caused by:

  • Collision or accident
  • Negligent or improper operation
  • Unauthorized drivers
  • Improper fuel
  • Interior damage
  • Excessive stains or odors
  • Smoking or vaping
  • Pet-related damage where prohibited
  • Off-road or prohibited use
  • Negligent loading or unloading
  • Failure to secure the vehicle
  • Water or flood damage resulting from prohibited use
  • Damage caused by failure to follow vehicle instructions

The Company may charge the Renter for reasonable repair or related costs where permitted by law.

14. Accidents and Mechanical Problems

The Renter must immediately notify the Company of any accident, collision, theft, vandalism, damage, or significant mechanical problem involving the vehicle.

In the event of an accident, the Renter must:

  1. Stop the vehicle safely.
  2. Contact emergency services when necessary.
  3. Exchange information with other involved parties as legally required.
  4. Notify law enforcement when required.
  5. Obtain an accident or police report when applicable.
  6. Notify the Company as soon as reasonably possible.
  7. Cooperate with insurance claims and investigations.

The Renter must not admit liability or make settlement agreements on behalf of the Company without authorization.

15. Breakdown and Roadside Assistance

If the vehicle experiences a mechanical problem, the Renter should contact the Company or the designated roadside assistance provider.

The Renter must not authorize major repairs without prior approval from the Company except where emergency action is reasonably necessary to protect persons or prevent additional damage.

Unauthorized repairs may not be reimbursed.

16. Prohibited Smoking and Vaping

Smoking and vaping may be prohibited inside Company vehicles.

If smoking, vaping, or another prohibited activity results in excessive odor, stains, burns, or other damage requiring professional cleaning or repair, the Renter may be responsible for applicable cleaning or restoration charges.

17. Pets and Animals

Animals may only be transported in accordance with the Company’s applicable vehicle-use rules.

The Renter is responsible for any cleaning, damage, or other costs caused by an animal, except where prohibited by applicable law.

Service animals will be accommodated as required by applicable law.

18. Fuel and Charging

The vehicle must be returned with the fuel or charge level specified in the rental agreement.

The Renter may be charged for missing fuel or charging capacity and any applicable refueling or service fee.

The use of the incorrect fuel or improper charging equipment may result in additional charges for towing, repair, cleaning, or other related expenses.

19. GPS and Telematics

Some vehicles may be equipped with GPS, telematics, or other vehicle-monitoring technology.

As described in our Privacy Policy, these systems may collect information such as vehicle location, speed, fuel level, mileage, diagnostic information, and other vehicle-related data.

The Renter agrees not to disable, remove, modify, obstruct, or interfere with such equipment.

Telematics may be used for legitimate business purposes, including vehicle security, fleet management, maintenance, recovery of vehicles, and responding to accidents or violations, subject to applicable law.

20. Vehicle Theft or Unauthorized Use

The Renter must take reasonable steps to protect the vehicle from theft or unauthorized use.

The vehicle must be locked when unattended, and keys or access devices must be kept secure.

The Renter must immediately notify the Company and law enforcement if the vehicle is stolen.

Failure to take reasonable precautions may result in additional liability to the extent permitted by law.

21. Vehicle Return

The vehicle must be returned:

  • At the agreed date and time;
  • To the agreed return location;
  • With the required keys and equipment;
  • In accordance with the applicable fuel or charging requirements; and
  • In substantially the same condition as received, subject to ordinary wear and tear.

Leaving a vehicle unattended at an unauthorized location does not necessarily constitute a completed return.

22. Late Returns

The Renter must contact the Company before the scheduled return time if additional rental time is required.

Additional rental charges may apply to late returns.

Unauthorized possession of a vehicle beyond the agreed rental period may result in additional fees and other actions permitted by the rental agreement and applicable law.

23. Early Returns

Unless otherwise stated in the rental agreement, returning a vehicle earlier than the scheduled return date does not automatically entitle the Renter to a refund.

Any refund or adjustment will be handled according to the applicable reservation and rental terms.

24. Cancellation and No-Show Policy

Cancellation and no-show terms may vary depending on the reservation or rental agreement.

Any applicable cancellation fees, deposits, or refund conditions will be disclosed at the time of booking or in the applicable rental agreement.

The Company may cancel a reservation when the Renter fails to meet eligibility, documentation, payment, insurance, or vehicle-use requirements.

25. Unauthorized Drivers

Only drivers approved by the Company and identified in the applicable rental agreement may operate the vehicle.

Allowing an unauthorized person to drive the vehicle may violate the rental agreement and may result in additional charges, termination of the rental, and loss of applicable protections, subject to applicable law.

26. Personal Property

The Company is not responsible for personal property left in a vehicle after the rental period, except where required by applicable law.

The Renter should remove all personal belongings before returning the vehicle.

27. Vehicle Recovery

If a vehicle is not returned as agreed, is abandoned, is reported stolen, or is otherwise subject to lawful recovery, the Company may take reasonable steps to recover the vehicle.

The Renter may be responsible for reasonable recovery, towing, storage, and related costs where permitted by law and the rental agreement.

28. Privacy

Personal information collected during the rental process is handled in accordance with our Privacy Policy.

By renting a vehicle, you acknowledge that information may be collected and processed for purposes including reservation management, identity verification, payment processing, vehicle security, fleet management, customer service, legal compliance, and other legitimate business purposes described in our Privacy Policy.

29. Text Messaging

If you voluntarily opt in to receive text messages from us, you consent to receive applicable operational or other permitted communications.

Message and data rates may apply.

You may opt out of marketing or other eligible text communications by replying STOP to a text message.

Additional mobile messaging practices are described in our Privacy Policy.

30. Compliance With Laws

The Renter agrees to comply with all applicable federal, state, county, and local laws, rules, regulations, and ordinances while operating or possessing the vehicle.

The Renter is solely responsible for violations arising from their use or operation of the vehicle, except where otherwise required by law.

31. Limitation of Liability

To the maximum extent permitted by applicable law, the Company will not be responsible for indirect, incidental, special, consequential, or punitive damages arising from the rental or use of a vehicle, except where such limitation is prohibited by law.

Nothing in these Terms is intended to waive or limit any rights or protections that cannot legally be waived or limited.

32. Indemnification

To the extent permitted by applicable law, the Renter agrees to be responsible for claims, losses, fines, penalties, costs, or expenses arising from the Renter’s unlawful, unauthorized, negligent, or prohibited use of the vehicle.

This provision does not apply to the extent a claim results from the Company’s own conduct where applicable law prohibits such indemnification.

33. Termination of Rental

The Company may terminate a rental when permitted by the rental agreement or applicable law, including circumstances involving:

  • Failure to make required payments;
  • Providing false or fraudulent information;
  • Unauthorized use of the vehicle;
  • Use of the vehicle for illegal purposes;
  • Unauthorized drivers;
  • Failure to maintain required insurance;
  • Material violation of the rental agreement;
  • Failure to return the vehicle as agreed; or
  • Circumstances creating a legitimate safety or security concern.

If a rental is terminated, the Renter must promptly return the vehicle as directed by the Company.

34. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, business practices, legal requirements, or other operational needs.

The version applicable to a particular rental will generally be the version incorporated into or referenced by the applicable rental agreement, subject to applicable law.

35. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

36. Governing Law

These Terms will be governed by applicable law, subject to any mandatory consumer protection or other laws applicable to the Renter or rental transaction.

Nothing in these Terms is intended to deprive a consumer of rights that cannot legally be waived.

37. Entire Agreement

These Terms, together with the applicable reservation confirmation, rental agreement, vehicle inspection documentation, and any additional terms provided by the Company, constitute the agreement governing the applicable rental transaction.

If there is a conflict between these Terms and a signed rental agreement, the applicable rental agreement will control to the extent permitted by law.
